Applying for a TEN
Applicants
Applicants must be aged 18 years or older.
A temporary event notice (TEN) may only be given by an
individual and not, for example, by an organisation or club or
business. The individual giving the notice is the proposed
“premises user”. Within businesses, clubs or organisations one
individual will therefore need to be identified as the proposed
premises user.
An 'associate' of the proposed premises user is:
- the spouse of that person;
- a child, parent, grandchild, grandparent, brother or sister of
that person;
- an agent or employee of that person; or
- the spouse of a person within (2) or (3).
For these purposes, a person living with another as that
person’s husband or wife is to be treated as that person’s
spouse.
Application process
The council's staff must be able to read the form easily. If
areas of the form are left blank or items are omitted, it will be
returned to the applicant as an invalid application. The council
will acknowledge receipt of the notice by giving a notice to the
premises user before the end of the first working day it was
received or before the end of the second working day if the day the
notice was received is not a working day.
You can apply by submitting the following:
- a completed temporary event
notice (Word) submitted at least 10 working days for a
standard TEN or at least five working days for a late TEN to
the Licensing Authority prior to the event date;
- The relevant fee of £21 must accompany the
notice. Make a
payment.

Your contact details
If you include an email address the licensing authority may send
the acknowledgement of receipt of your notice or any notice or
counter notice it is required to give under the relevant sections
of the Licensing
Act 2003. Please make sure you can provide us with a mobile
number so that you can be reached by Police, Environmental Health
and the Licensing Authority.
Description
A detailed description of the nature of the premises will assist
the Police and Environmental Health in deciding if any issues
relating to the licensing objectives are likely to arise.
You should state clearly that the premises to be used, for
example, a public house, a restaurant, an open field, a village
hall or a beer tent.
A detailed description of the event taking place at the premises
which will assist the Police and Environmental health in deciding
as to whether or not to make an objection. You should clearly
state that the event taking place would be for example a wedding
with a pay bar, the supply of beer at a particular farmers market,
a discotheque, the performance of a string quartet, a folk group or
a rock band.
Apply online
If you are giving this notice to the licensing authority by
means of the relevant electronic facility, you are not required to
send a copy of the notice to the Chief Officer of Police or
Environmental Health.

Will tacit consent apply?
Yes. This means that you will be able to act as though your
application is granted if you have not heard from the council by
the end of the notice period.
Timescales
Standard Temporary Event Notice (STEN)
It is a requirement that you send at least one copy of the
notice to the licensing authority at least 10 working days before
the commencement of the proposed licensable activities / event. The
authority will give you written acknowledgement of the receipt of
the notice. This will be important proof that you gave the notice
and when you gave it for the purposes of the Act.
Late Temporary Event Notice (LTEN)
It is a requirement that you send at least one copy of the
notice to the licensing authority at least five working days
but no earlier than nine working days before the commencement
of the proposed licensable activity or event. A late
notice given later than five working days before the event to
which it relates will be returned as void and the activities
described in it will not be authorised. The authority will
give you written acknowledgement of the receipt of the
notice. This will be important proof that you gave the notice
and when you gave it for the purposes of the Act.
If there is an objection from either the police or local
authority exercising environmental health functions, the event will
not go ahead and a counter notice will be issued.
Serving the Temporary Event Notice on relevant agencies
The original notice must be sent to the licensing unit. A
copy of the the notice must be sent to both Environmental Health
and Kent Police. Contact details are provided.

Objections
The police and local authority exercising environmental health
functions may intervene on the grounds of any of the four licensing
objectives (the prevention of crime and disorder, public safety,
the prevention of public nuisance and the protection of children
from harm) to prevent the occurrence of an event at which permitted
temporary activities are to take place or to agree a modification
of the arrangements for such an event. However, the licensing
authority will intervene of its own volition in the cases
described
- Firstly, it will issue a counter notice if there is an
objection to a late temporary event notice.
- Secondly, it may issue a notice in relation to its decision to
impose conditions on a temporary event notice.
- Thirdly, it will issue a counter notice if the limitations are
exceeded. If the limits are breached or if a counter notice
has been issued, any licensable activities taking place would be
unauthorised and the premises user would be liable to
prosecution.
