Gating orders

When residents ask the council to make gating orders, information on the location of the proposed gating scheme and a draft of the order will be published here.

Anybody wishing to make written representations as to whether or not the order should be made may do so within 28 days of the date of first publication of the notice. Written representations should be sent to the address at the foot of this page.

Gating orders are displayed under the Highways Act 1980 (Gating Order) (England) Regulations 2006.

Cromwell Terrace, Chatham

This is to inform the public of the proposed Gating Order on an alley at Cromwell Terrace, Chatham, which is situated between numbers 28 and 29 Cromwell Terrace leading in a southerly direction terminating at the rear or 28 Cromwell Terrace and 20 Hartington Street, Chatham. The general effect of the order will be to restrict at all times the public right of way to all persons so that passage and re-passage shall not occur.

The Order will state:

  1. The Council is satisfied that the conditions set out in section 129A(3) of the Highways Act 1980 have been met.
  2. Access to the alleyway will be suspended at all times to the general public through the erection of gates at either end of the restricted highway.
  3. Persons who are excluded from the effect of the restrictions include, Police, Fire and Rescue Services, NHS Trust/Foundation Trust staff in exercise of their duties, persons using the highway in connection with the laying, erection, inspection, maintenance, alteration, repair, renewal or removal in or near the said length of highway of any sewer, main, pipe, conduit, wire, cable or other apparatus for the supply of gas, water, electricity or of any communication apparatus as defined in Schedule 2 of the Telecommunications Act 1984. Council Staff and its authorised contractors when in exercise of their duties. Persons using the highway with the permission or at the direction of a duly authorised council officer in this regard.
  4. The alternative route for the public is via Cromwell Terrace and Otway Street.
  5. Responsibility for the gate’s maintenance lies with Medway Council.

Please note that all representations received may be considered in public by the Council and that the substance of any representation together with the name and address of the person making it could become available for public inspection.

Notice is hereby given that Medway Council intends to make a gating order pursuant to the provisions of Section 129A of the Highways Act 1980 and a draft of that Order is set out herein. Anybody wishing to make written representations as to whether or not the Order should be made may do so within 28 days of the date of the first publication of this notice. Written representations should be sent to Angela Drum, Head of Legal Services, at the address at the foot of this page.

It appears to Medway Council that the alley leading from Darnley Close, Strood to the service area to the rear of 41 to 47 Carnation Close, Strood should be the subject of a Highways Act 1980 Section 129A Gating Order (pdf 502KB). Medway Council is satisfied that the conditions as set out in Section 129A(3) of the Highways Act 1980 have been met. The effect of the Gating Order will be to restrict the public right of way along the relevant highway.

Alternative access on foot from Darnley Close will be by way of Darnley Road, Columbine Road and Carnation Road. Medway Council will be responsible for the maintenance of the gates.

It appears to Medway Council that the service road leading off Shipwrights Avenue to the rear of 163 to 287 Castle Road Chatham should be the subject of a Highways Act 1980 Section 129A Gating Order.

Medway Council is satisfied that the conditions as set out in Section 129A(3) of the Highways Act 1980 have been met. The effect of the Gating Order will be to restrict the public right of way along the relevant highway. Access will be restricted to key holders only.

Medway Council will be responsible for the installation and maintenance of the gate.

It appears to Medway Council that the alleyway leading from Freshwater Road to Coverdale Close, Walderslade should be the subject of a Highways Act 1980 Section 129A Gating Order.

Medway Council is satisfied that the conditions as set out in Section 129A(3) of the Highways Act 1980 have been met. The effect of the Gating Order will be to restrict the public right of way along the relevant highway. Access to the relevant highway will be restricted to key holders only.

Alternative access on foot will be by way of Freshwater Road and Heron Way. Medway Council will be responsible for the maintenance of the gate.

St Albans Walk, Chatham

It appears to Medway Council that the alleyway leading from Ordinance Street, Chatham to Pagitt Street, Chatham and known as St Albans Walk and further an alleyway from Haymen Street, Chatham to a point on St Albans Walk to the rear of 4 Pagitt Street and 77 Ordinance Street aforesaid should be the subject of a Highways Act 1980 Section 129A Gating Order.

Medway Council is satisfied that the conditions as set out in Section 129A(3) have been met. The effect of the Gating Order is to restrict the public right of way along the relevant highways. Access will be restricted to key holders only.

Alternative access on foot from Ordinance Street will be by way of Watts Street or Haymen Street. Medway Council will be responsible for the maintenance of the gate.

It appears to Medway Council that the alley leading from Havisham Close, Rochester to Barnaby Terrace, Rochester, the relevant highway, should be the subject of a Highways Act 1980 section 129A Gating Order.

Medway Council is satisfied that the conditions set out in Section 129A(3) of the Highways Act 1980 have been met. The effect of the Gating Order will be to restrict the public right of way along the relevant highway. Access will be restricted to key holders only.

The alternative route on foot will be by way of Marley Way or Dorrit Way. Medway Council will be responsible for the installation and maintenance of the gates.

Alley between Tedder Avenue and Frost Crescent, Chatham

It appears to Medway Council that the pedestrian only alley as shown on the map annexed hereto leading from Tedder Avenue, Chatham to Frost Crescent, Chatham, being a relevant highway, should be the subject of a Highways Act 1980, Section 129A Gating Order.

Medway Council is satisfied that the conditions as set out in Section 129A (3) of the Highway Act 1980 have been met. The effect of the Gating Order will be to prevent the public using the right of way along the relevant highway so that public access will not be available at any time.

Alternative access is by the existing pavement in Tedder Avenue, Wayfield Road and Frost Crescent. Vehicular traffic is not affected by the making of this Order.

Medway Council will be responsible for the maintenance of the gates.

Gatekeeper Chase, Rainham

Gatekeeper Chase, Rainham

It appears to Medway Council that the alleyway as shown on the map annexed hereto leading from Gatekeeper Chase, Rainham leading to Church Path, Rainham, being a relevant highway, should be the subject of a Highways Act 1980, Section 129 Gating Order.

Medway Council is satisfied that the conditions as set out in Section 129A (3) have been met. The effect of the Gating Order is to restrict the public right of way along the relevant highway so that public access is only available between the hours of 7am and 7pm. Between the hours of 7pm and 7am, passage through the gate will be restricted to key-holders only.

Alternative access on foot to and from Church Path will be by way of Hurst Place and vehicular access to Gatekeeper Chase is unaffected by this Order.

The person or persons responsible for the opening and closing of the gate are Stuart Lamont and David Johns of 7 and 20 Gatekeeper Chase respectively. Medway Council is responsible for the maintenance of the gate.

This Order takes effect on the signing hereof.
