What is late night refreshment?
Supplying hot food or hot drink to the public for consumption on or off the premises between 11pm and 5am. Food or drink is defined as hot if:
- it is heated on the premises or elsewhere before it is supplied to the public or
- the temperature of the food or drink is above ambient air temperature.
If you sell hot food or drink after 11pm, please apply for a Premises Licence.
Exempt premises
Vending machines are exempt if customers can help themselves to hot drinks only.
Penalties
A person commits an offence if he or she carries on or attempts to carry on a licensable activity on or from any premises without authorisation by the council. A person found guilty of holding unauthorised activities is liable to imprisonment for a term not exceeding six months or to a fine not exceeding £20,000 or both. It will be for the convicting court to decide what is an appropriate and proportionate sentence within the maximum provided.
