Application forms
An application form can be obtained from the council either by visiting the reception desk at the address below or by requesting one by post. To download a form, please visit www.culture.gov.uk/what_we_do/alcohol_and_entertainment/3189.aspx.
Council staff must be able to read the form easily. If areas of the form are left blank or items omitted, the form will be returned to the applicant as an invalid application.
New application for a Premises Licence
Applicants will be required to complete and produce the following:
- completed application form (Schedule 2 Regulation 10),
- relevant fee,
- plan of the premises,
- consent form completed by the proposed designated premises supervisor.
They must also advertise the application and send copies to the Responsible Authorities.
Application to vary a Premises Licence
Applicants will be required to complete and produce the following:
- completed application form (Schedule 4 Regulation 12),
- relevant fee,
- plan of the premises, if different from original application.
- the Premises Licence or relevant part of it or an explanation of the proposed variation.
They must also advertise the application and send copies to the Responsible Authorities.
Transfering a Premises Licence holder
The existing Premises Licence holder must give consent for the new applicant to transfer on the licence (Part B of Schedule 11 regulation 24). The new applicant must complete an application form (Schedule 6 Regulation 14).
Interim Authority
Applicants will be required to complete and produce the following:
- completed application form (Schedule 7 Regulation 15),
- relevant fee.
They must notify the Designated Premises Supervisor (if different from the Premises Licence holder) and send copies of the documentation to the police.
Provisional Statement
Applicants will be required to complete and produce the following:
- completed application form (Schedule 3 Regulation 11),
- relevant fee,
- a plan of the works to be done at the premises,
- a plan of the premises.
They must also advertise the application and send copies to the Responsible Authorities.
Rights of an individual who has a property interest
A person has a property interest if they:
- hold a legal interest in the premises as a freeholder or leaseholder,
- are the legal mortgagee of the premises,
- live on the premises,
- have a prescribed interest in the premises.
To apply for notification of licensing matters in relation to a property, the applicant will be required to complete a form (Schedule 1 Regulation 9) and enclose the relevant fee.
Hearings
Responsible Authorities and Interested Parties can object to an application on grounds under the four licensing objectives. If the council receives such an objection, a hearing will be arranged for all parties to attend and explain their positions.
Appeals
If an application is refused for any reason, the applicant will be entitled to appeal against the decision at a magistrate's court. Similarly, if the application is granted despite a police representation, the chief officer of police is entitled to appeal against the council’s decision.
Review of licences
At any stage a Responsible Authority or Interested Party may ask the council to review a Premises Licence in connection with the four licensing objectives.
