Gambling Act 2005 fees

The Gambling Act 2005 (www.opsi.gov.uk/Acts/acts2005/ukpga_20050019_en_1) fees came into force in March 2007. All fees are based on a maximum fee set by central government. Medway Council is therefore able to charge an amount up to the maximum fee set by central government. The relevant fee is non-refundable - the fee is not for holding a licence but for the work needed to process the application, even if this results in a refusal.

The fees and charges for 2008/2009 were agreed by the council on 28 February 2008. These fees were applicable from 1 April 2008 and represent an inflation increase of approximately 2.5 per cent on the fees for 2007/2008.

Variation

If you are an existing licence holder and wish to amend your application please apply for a variation. Forms can be obtained by contacting the licensing unit. Fees are represented by the type of Premises Licence you are applying for.

New Application

If you are applying for a new premises please apply for a non-conversion application (new premises). Forms can be obtained by contacting the licensing unit. Fees are represented by the type of Premises Licence you are applying for, please make sure that you have already obtained or applied for your operators licence from the Gambling Commission before submission to the council.

Provisional Statement

If you are currently considering on in the process of building a premises and want to apply for a licence you will need to apply for a provisional statement. Forms can be obtained by downloading them by contacting the licensing unit. Fees are represented by the type of Premises Licence you are applying for, please make sure that you have already obtained or applied for your operators licence from the Gambling Commission before submission to the council.

Annual fee

The first annual fee for the licence must be paid within 30 days after the initial grant date of the licence. Future annual fees will be payable on the anniversary of the licence coming into force (the effective date).

For first annual and annual fees for premises licences that are subject to a seasonal condition, the relevant licensing authority may determine a lesser annual fee. This will only apply when a seasonal condition relates to activities specified in the licence for part of a year only.

Copy of a licence

The amount of the fee under section 190(1) to accompany a copy of a licence application is £25.

Change of circumstance fee

The amount of the fee under section 186(3)(a) to accompany a change of circumstance application is £50.
