Administrative penalties

12.1	These will be issued in accordance with the legislation contained in the Social Security Administration Act 1992, inserted by the Social Security Administration (Fraud) Act 1997.
12.2	An administrative penalty will not be placed before the court if any prosecution is subsequently taken before the expiry date of the administrative penalty.
12.3	If a person re-offends after being given an administrative penalty, Medway Council could, in certain circumstances, offer a formal caution.
