Traffic Penalty Tribunal

The Traffic Penalty Tribunal is an independent body, unconnected with Medway Council. The adjudicators are qualified lawyers who have no connection with anyone involved in the cases which they decide. They consider all the evidence submitted in each case, reach a decision on the facts and then apply the law.

There are two types of hearings available to the appellant, a postal hearing or a personal hearing.

A postal hearing is where the appeal is dealt with in writing and all evidence is provided by post.

A personal hearing will last around 20 minutes and can take place in one of a number of locations. This gives the appellant the opportunity to give their evidence verbally to the adjudicator. The hearing may also be recorded.

The adjudicator then decides whether the appeal against Penalty Charge Notice (PCN) should be allowed or dismissed.

If the appeal is allowed, the Traffic Penalty Tribunal instructs the council to cancel the PCN. If the appeal is dismissed, the appellant is instructed to pay the Notice at the full charge.
