Medway Council has wide ranging powers under various acts of Parliament to prevent danger and nuisance on the highway.
Highway law can be very complicated and it is easy to misinterpret the powers available to the council and how they can be used. Some of the main enforcement areas are listed below, with Highways Act 1980 section references:
- damaging the highway (sections 130 to 136);
- obstructing the highway (sections 137, 138, 143, 147A, 148, 149, 150, 151, 152, 153);
- controlling skips, flagpoles, gates, stiles and planking (sections 139 to 142 and 144 to 147);
- overhanging vegetation (section 154);
- danger or annoyance from animals, fires, ropes, water, barbed wire, dangerous land and walls.
