Traffic Penalty Tribunal
The Traffic Penalty Tribunal is an independent body, unconnected
with Medway Council. The adjudicators are qualified lawyers who
have no connection with anyone involved in the cases which they
decide. They consider all the evidence submitted in each case,
reach a decision on the facts and then apply the law.
There are three types of hearings available to the
appellant:
- a postal hearing;
- a personal hearing; or
- a telephone hearing.
A postal hearing is where the appeal is dealt with in writing
and all evidence is provided by post or email.
A personal hearing will last around 20 minutes and can take
place in one of a number of locations. This gives the appellant the
opportunity to give their evidence verbally to the adjudicator. The
hearing may also be recorded.
A telephone hearing will also last around 20 minutes and takes
place by means of a telephone conference call facilitated by the
Tribunal.
The adjudicator then decides whether the appeal against Penalty
Charge Notice (PCN) should be allowed or dismissed.
If the appeal is allowed, the Traffic Penalty Tribunal instructs
the council to cancel the PCN. If the appeal is dismissed, the
appellant is instructed to pay the Notice at the full charge.
