How we allocate places if your child has an EHC Plan
We allocate places at special settings based on your child's special educational needs or disabilities.
We do not allocate places based on distance.
Places at independent or private settings
We can consult with independent or private settings to see if they’re suitable for your child.
We cannot agree to name an independent or private setting on your child’s EHC Plan if a local maintained setting can meet your child’s needs.
This is because:
- we must use resources efficiently in line with statutory responsibilities. This is to support all children and young people with SEND in Medway
- there may be a safeguarding concern found through inspections.

Section 41
A section 41 approved setting is an independent setting that has been officially recognised by the government for supporting children and young people with SEND.
Independent and private settings can be section 41 approved or not.

There are not any section 41 approved independent settings based in Medway at this time.

Independent and private settings that are not section 41 approved
You can apply for an independent setting that is not section 41 approved. We will consider your preference.
We do not have a legal obligation to:
- consult with independent settings that are not section 41 approved
- name an independent setting in your child’s EHC Plan if it is not section 41 approved.
Places at a maintained setting in Kent
If you name a maintained setting in Kent as your preference, we will consult with them.
We will also consult with the relevant Local Authority that maintains the setting in Kent.
Your Medway EHC Plan Coordinator will confirm which setting will be named on your EHC Plan.
Transport assistance
You may be eligible for home to school travel assistance.
You can apply for this once your child's EHC Plan has their education setting on it.
Having an EHC Plan does not guarantee transport for your child or young person.
