The Duty to Consult

All local councils must consult residents on the felling of street trees where no exemptions apply.

This follows the 'Duty to Consult' legislation (Section 115 of the Environment Act 2021) coming into force on 30 November 2023.

It aims to ensure local people can express their views over the proposed management of street trees in their area. The duty will ensure the decision-making process is more transparent and considers the views of local people.

Medway street trees

Most street trees in Medway that we fell would be exempt from the legislation as we're felling them for safety reasons. However, there may be occasions when we're considering felling a street tree.

Where we have a duty to consult, the details of the trees we are proposing to fell, including the reason, will be in the table below.

Alternative solutions

The site has been assessed and evidence was found to confirm the tree’s influence on its immediate surroundings.

Following a review, the decision has been made to proceed with removal of the tree in the interest of managing the site appropriately.

We will not be able to reuse the planting pit. Replanting will be considered for a more appropriate Highway verge within the Gillingham South ward at a later date.

Between Monday 22 September and Monday 20 October 2025, we want to hear your views on the proposed felling.

Our decision will be published no later than 28 days before any felling takes place.
