Appeal a Housing Benefit decision

If you are unhappy with a Housing Benefit decision, you can make an appeal. You have one month to make an appeal from the date of your decision letter.

When we receive your appeal: 

  • a different member of staff to the person who assessed your initial claim will look at the decision 
  • your claim will be thoroughly checked 
  • you will receive a letter confirming our decision following the appeal. 

Appeal a Housing Benefit decision

If your appeal is unsuccessful 

If we stand by our original decision, we will send your appeal to HM Courts and Tribunals Service and an independent tribunal made up of people who are not part of the council will consider your case.

You can attend the appeal in person and take a representative with you. You can also call witnesses. Many hearings now take place over the phone or via video calls.

If you do not wish to attend the hearing, you can send HM Courts and Tribunals Service any information that you would like considered.

A decision notice explaining the tribunal’s decision will be sent as soon as possible after the hearing. 

If your appeal is successful 

We will amend your claim and confirm this in writing to you once we receive confirmation of the decision

Appeal a Council Tax Reduction decision 

If you are unhappy with a Council Tax Reduction decision, you can make an appeal. You have 2 months to make an appeal from the date of your decision letter.

When we receive your appeal: 

  • a different member of staff to the person who assessed your initial claim will look at the decision 
  • your claim will be thoroughly checked 
  • you will receive a letter confirming our decision following the appeal. 

If we have not replied to your appeal within 2 months or you are unhappy with our decision, you can appeal directly to the Valuation Tribunal. 

Appeal a Council Tax Reduction decision

What to do while your appeal is being considered

You must continue to pay your Council Tax while your appeal is being considered. If you cannot do this, you need to email ctax@medway.gov.uk.  

If your appeal is successful and your Council Tax is reduced, we will refund any overpayment to you.
