Apply to work on a protected tree

A protected tree can either be in a conservation area or have a Tree Preservation Order (TPO). Before you begin or plan any works to a tree, you should check if the tree is protected.

If the tree is protected, you'll need to apply for tree works.

Emergency 5 day notice

You can apply for a 5 day notice if a protected tree is causing immediate danger to life or property.

What to submit

For tree works, you’ll need a:

  • completed application form
  • plan showing the location of the trees
  • statement of reasons for the proposed works
  • full and clear specification of the works to be carried out.

Works need to be clear and full and include both cut back measurements and finished measurement.

An example of this would be: T1 - Oak tree - reduce height of tree by 1m, from a total height of 8 metres to 7 metres.

How to apply

You can apply online for permission to carry out work on a protected tree on the Planning Portal.

To apply online, enter your postcode and select ‘Tree works: Trees in conservation areas/subject to TPOs’.

If you cannot apply online, you can print an application form and post it to: The Planning Service, Gun Wharf, Dock Road, Chatham, Kent, ME4 4TR.

After you've applied

Once you’ve submitted your application, you'll get an email to let you know your application has been submitted successfully.

We'll review the information and application, and email you in around 5 working days to let you know if the request is valid or if we need further information.

If your request is valid, we'll publish the application and complete any required consultations before you receive the decision.

Decisions on your tree works application

There is an 8 week processing time for a TPO and a 6 week processing time for works to trees in a conservation area.

If your application is approved, you'll receive a legal decision notice.

Your approval may be ‘subject to conditions’, read your decision notice carefully.

You can start work within the time limit as long as you comply with any set conditions.

If your application is refused your decision notice will explain why it was refused.

You can:

  • send a pre-application request to discuss reasons for refusal
  • change your proposal and resubmit.
