5 day notice
If a protected tree is causing immediate danger to life or property, you can apply for a 5 day notice.
The 5 day notice is an exemption from the 6 or 8 week decision process applications normally must go through.
To get a 5 day notice, you'll have to meet very strict rules.
If you need to apply for works to a protected tree that is not urgent, you can apply for works to a protected tree online.
We'll make a decision in 5 days based on the information you give us about the tree and the danger it may cause if the works are not completed quickly.
How to apply for a 5 day notice
To apply for a 5 day notice, you can use our online form.
In the form, you'll need to tell us:
- your contact details
- where the tree is including an address and a map or what3words
- if you're pruning or cutting down the tree
- the tree preservation order (TPO) reference number (if known)
- how many trees you're applying for
- the species of the tree (if known)
- evidence (photos of the tree or a survey).
After you've applied
Once you have applied, you'll get a confirmation email that your application has been received.
We'll look at all of the information and evidence and decide if the 5 day notice can be given.
We'll then contact you within 5 working days and let you know our decision and what you'll need to do next.
If your application is approved, you'll be sent a legal decision notice and works can begin straight away. If you're cutting down a tree (felling), depending on the type of order, you might need to plant a replacement tree.
If your application is denied, works cannot begin until you've completed the standard application for works to a protected tree online.
This takes either 8 weeks for a tree with a TPO or 6 weeks for a tree in a conservation area without a TPO.
