Illegal evictions
An illegal eviction is if your private landlord or someone acting on their behalf:
- changes the locks
- tries to make you leave with threats or harassment
- uses force to make you leave
- stops you from getting into parts of your home.
Illegal evictions are a criminal offence.
Landlords must follow the correct process if they want you to leave a property. The type of tenancy or agreement you have with them will control what steps they must follow.
Only court bailiffs can evict you. If anyone else tries to make you leave, it's an illegal eviction.
This applies to:
- private tenants
- property guardians
- students in halls of residence.
It does not apply if you:
- are a lodger
- share a living space with your landlord.
Steps you should take

- seek independent legal advice through a legal advisor.

- look into claiming compensation from your landlord.
